TNS Guide to Information & Publication Scheme
Under the Freedom of Information (Scotland) Act 2002 TNS must produce and maintain a publication scheme. A publication scheme shows the information TNS already publishes, or intends to publish
where you can find that information, and whether it is available free of charge or for a fee.
TNS has adopted the Model Publication Scheme 2016 approved by the Scottish Information Commissioner on 29 March 2016.
If you would like the Model Publication Scheme or the Guide to Information in a different format please contact the School Office.
How to make an information request to TNS:
The TNS is subject to freedom of information law. So we must respond to requests that we receive for information that we hold and provide advice and assistance to requesters. If the information you want is not in our publication scheme, you have the right to request it from us.
You should make your request in writing or in another recordable format. You will need to provide:
- Contact details so that TNS can respond (an email address will do)
- A description of the information you would like us to provide
You do not need to say why you want the information, but if you do, it may help us to identify the information you want to see. You should send your request to us by email or by post to:
The New School
If you need help to make your request, please contact us.
Please note that if you want to request information about yourself (personal data) then this should be done by way of a subject access request under the Data Protection Act 1998. Subject access requests should also be sent to the contact details above and TNS will normally require proof of identity and £10.
How we charge for information that is not published
This relates to information which TNS does not routinely publish, but which anyone can request from us.
TNS do not charge for:
(1) the time it takes to decide whether we hold the information you asked for
(2) the time it takes us to decide whether the information can be disclosed.
Charges may be made for
(1) the staff time taken to locate and retrieve the information and
(2) for providing it to you.
Charges are calculated on the basis of the actual cost to TNS of providing the information. Staff time is charged at the average hourly rate of pay for the grade(s) of the staff responding to the request, up to a maximum of £15 per hour per member of staff.
We do not charge for information which costs less than £100 to provide to you.
Where information costs between £100 and £600 to provide to you, we may ask to you to pay 10% of the cost of providing it.
Where information costs over £600 to provide to you, TNS may refuse to deal with your request or may ask you to pay the additional cost over that amount in full.
If we indented to make a charge we will contact you to issue a Fees Notice before we sent any information. The Fees Notice will set out the charge and how it has been calculated as well as how to pay it. If TNS does not hear from you within 20 working days of issuing a Fees Notice we will assume that you have withdrawn your request.
